Adoption of the Cheshire East Local Plan Strategy

I am writing to inform you that Cheshire East Council adopted the Local Plan Strategy Development Plan Document on 27 July 2017. The Local Plan Strategy now forms a key part of the statutory development plan for the borough, which is the basis for determining planning applications. The formal adoption statement is set out at the end of this email message.

CHESHIRE EAST LOCAL PLAN STRATEGY

ADOPTION STATEMENT: 27 JULY 2017

Notice is hereby given that Cheshire East Borough Council resolved to adopt the Cheshire East Local Plan Strategy Development Plan Document on 27 July 2017.

The Local Plan Strategy replaces a number of ‘saved’ policies from the Congleton Borough Local Plan First Review (adopted 2005); the Borough of Crewe and Nantwich Replacement Local Plan 2011 (adopted 2005); the Macclesfield Borough Local Plan (adopted 2004); the Cheshire Replacement Minerals Local Plan (adopted 1999); and the Cheshire Replacement Waste Local Plan (adopted 2007) as set out in Appendix B of the adopted Local Plan Strategy.

The Local Plan Strategy is the council’s spatial policy framework for delivering sustainable economic growth and vibrant sustainable communities and for the management of development in Cheshire East up to 2030. It has been subject to examination by an independent inspector appointed by the Secretary of State and a number of main modifications were made to the Local Plan Strategy Submission Document (March 2014) as set out in the Schedule of Main Modifications to the Cheshire East Local Plan Strategy accompanying the inspector’s report. Pursuant to Section 23(3) of the Planning and Compulsory Purchase Act, the adopted Local Plan Strategy incorporates these modifications. The Local Plan Strategy also incorporates a number of additional modifications as set out in Appendix 2 to the report to council.

Any person aggrieved by the adoption of the Local Plan Strategy may make an application to the High Court under Section 113 of the Planning and Compulsory Purchase Act 2004 on the grounds that:

  • The Local Plan is not within the appropriate power conferred by Part 2 of the Planning and Compulsory Purchase Act 2004;
  • A procedural requirement of the Planning and Compulsory Purchase Act 2004 or its associated Regulations has not been complied with.

Any such application should be made promptly and in any event no later than six weeks from the date of adoption.

The Local Plan Strategy, this adoption statement, the sustainability appraisal adoption statement and the inspector’s report are all available for inspection on the council’s website atwww.cheshireeast.gov.uk/localplan and at the council’s offices at Westfields, Middlewich Road, Sandbach CW11 1HZ; Macclesfield Town Hall, Market Place, Macclesfield SK10 1EA; and Delamere House, Delamere Street, Crewe CW1 2JZ during normal opening hours. In addition, the Local Plan Strategy and this adoption statement only are available to view at all public libraries in Cheshire East during normal opening hours.
